ConsumerSmart.net respects the intellectual property rights of others and expects its users, contributors, and service providers to do the same.

In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), ConsumerSmart.net will respond to valid notices of alleged copyright infringement involving material available on or through this website.

This policy explains how copyright owners may submit a DMCA takedown notice and how affected parties may submit a counter-notification when they believe material was removed or disabled because of a mistake or misidentification.

Copyright Infringement Notification

If you believe that copyrighted material owned by you or a person you represent has been copied, displayed, or otherwise used on ConsumerSmart.net without authorization, you may send a written DMCA notice to our designated copyright agent.

  6. A statement that the information contained in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Incomplete notices may delay our ability to investigate and respond to your claim.

Our Response to a DMCA Notice

After receiving a substantially compliant DMCA notice, we may:

  • Review the notice and the identified material

  • Contact the person who submitted the notice for additional information

  • Remove or disable access to the allegedly infringing material

  • Notify the person responsible for the affected material

  • Provide that person with information about submitting a counter-notification

  • Take other actions that we consider appropriate under applicable law

Removal of material does not constitute an admission that the material infringed copyright.

We reserve the right to remove or restrict access to content at our discretion, including when a notice does not fully satisfy the formal requirements of the DMCA.

Counter-Notification

If material that you submitted or are responsible for has been removed or disabled following a DMCA notice, and you believe the removal resulted from a mistake or misidentification, you may submit a written counter-notification to our designated DMCA agent.

Your counter-notification must include substantially all of the following:

  1. Your physical or electronic signature.

  2. Identification of the material that was removed or to which access was disabled.

  3. The location where the material appeared before it was removed or disabled, including the relevant URL when available.

  4. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of a mistake or misidentification.

  5. Your full name, mailing address, telephone number, and email address.

  6. A statement that you consent to the jurisdiction of the United States Federal District Court for the judicial district in which your address is located.

    If your address is outside the United States, the statement must provide that you consent to the jurisdiction of any United States Federal District Court in which the service provider may be found.

  7. A statement that you will accept service of process from the person who submitted the original DMCA notice or an authorized agent of that person.

Send the completed counter-notification to the designated DMCA agent listed above.

Restoration of Removed Material

When we receive a valid counter-notification, we may provide a copy to the person who submitted the original infringement notice.

Where required under the DMCA, the removed material may be restored or access to it may be re-enabled no sooner than 10 business days and no later than 14 business days after receipt of the counter-notification.

The material will not be restored if the original complaining party informs us that they have filed a legal action seeking a court order to prevent the person responsible for the material from engaging in the allegedly infringing activity.

We may also decide not to restore material when it violates another website policy or when we otherwise have an independent right to remove it.

Repeat Infringer Policy

Where appropriate and when technically possible, ConsumerSmart.net may restrict or terminate access for users, contributors, or account holders who repeatedly infringe copyrights.

We may consider the circumstances of each case, including the number and nature of infringement notices received, the validity of those notices, any counter-notifications, and any other relevant information.

This section applies only if ConsumerSmart.net allows users, contributors, or account holders to upload or submit content.

Misrepresentations

Submitting a DMCA notice or counter-notification is a serious legal matter.

Under Section 512(f) of the DMCA, a person who knowingly makes a material misrepresentation that content is infringing, or that content was removed because of mistake or misidentification, may be responsible for damages, costs, and attorneys’ fees.

Before submitting a notice, you should consider whether the disputed use may be authorized by the copyright owner, licensed, permitted under fair use, in the public domain, or otherwise allowed by law.

Disclosure of Information

We may provide a copy of a DMCA notice or counter-notification, including the sender’s contact information, to:

  • The person responsible for the disputed material

  • The person who submitted the original notice

  • Our hosting provider or other service providers

  • Our legal advisers

  • Government authorities or courts when legally required

  • Other parties when reasonably necessary to process the claim

Do not include sensitive personal information beyond what is required to process your notice or counter-notification.

Third-Party Content and Websites

ConsumerSmart.net may link to Amazon and other third-party websites.

We do not control material hosted on third-party websites. Copyright complaints involving material located on another website should generally be directed to the operator or designated DMCA agent of that website.

The presence of a link on ConsumerSmart.net does not mean that ConsumerSmart.net owns or controls the content available through that link.

Non-Copyright Complaints

The DMCA process applies specifically to copyright claims.

It should not be used for complaints involving:

  • Trademarks

  • Defamation

  • Privacy

  • Product disputes

  • Incorrect information

  • Advertising complaints

  • Unauthorized use of a person’s name or likeness

  • Order, payment, delivery, refund, or warranty issues
